In the coming days or weeks, you may hear some news about the Theodore case appeal. I am writing to give you a bit of information on that process. But most of all, I'm writing to assure you that nothing changes for you and your children.
On March 12 and 13, 2019, the Theodore case appeal will go before the Saskatchewan Court of Appeal. If you are unfamiliar with the Theodore case, or need a bit of a refresher, information can be found at www.opencatholiceducation.ca
This is not a trial. The appeal is a presentation of legal arguments. Parties will present how they believe the April 2017 decision erred in its interpretation and application of the law, or how they believe the decision should be upheld.
Again, nothing will change for you, your children and our Catholic school communities at this stage. The effect of the original decision has been stayed (put on hold) until a further order of the Court of Appeal. Also, the Government of Saskatchewan has passed legislation that will allow it to use the notwithstanding clause, if necessary, to set aside an unfavourable decision.
